These Terms and Conditions constitute the contract between you and BH Live. By making an application for a membership you also agree to comply with the Rules and Regulations which are accessible here: www.bhliveactive.org.uk/rulesandregulations

1. Our Sports Memberships

• • “Swimming Academy Membership” which is payable monthly by Direct Debit
  • “Swimming Academy Cash Plan” which is paid for in advance for a defined duration.
  • “Gymnastics Membership” which is payable monthly by Direct Debit
  • “Trampolining Membership” which is payable monthly by Direct Debit
  • “Pre-School Gymnastics Cash Plan” which is paid for in advance for a defined duration.
  • “Squad Fees Membership” which is payable monthly by Direct Debit
  • “Tennis Membership” which is payable monthly by Direct Debit
  • “Littledown Juniors Membership” which is payable monthly by Direct Debit during season.
  • “Littledown Juniors Cash Plan” which is paid for in advance for a defined duration of season.

2. Direct Debit Memberships

2.1 Sports Memberships will run for the Initial Term of 3 Direct Debit collections. The membership will continue beyond the Initial Term unless you give us notice to end your Membership. Payments following the Initial Term must be made by direct debit. If you wish to end your Sports Membership at the end of the Initial Term, we must receive your notice in line with notice periods outlined in 2.7.

2.2 Initial term does not apply to Littledown Juniors Memberships. Membership will run for the defined season period only.

2.3 On commencing your membership, any part monthly pro-rata payments must be made at the time of joining.

2.4 Exercising your right to change your mind. You have 14 days after the day we confirm your membership to change your mind. If you cancel after we have started the services, you must pay us for the services provided up until the time you tell us that you have changed your mind and stop using the services.

2.5 Your rights to freeze your Direct Debit membership. Sports memberships cannot be frozen except where you develop a medical condition which prevents you from using the services on an ongoing basis, in which case clause 2.5 below shall apply.

2.6 If you develop a medical condition which prevents you from using the services on an ongoing basis. An appropriate medical practitioner must provide written evidence, and we may, at our discretion, suspend your payments for two months. The participant will be removed from their sports course for the duration of the non-payment period. Courses spaces are subject to availability on return.

2.7 Cancellation of your Sports Membership. Notices must be submitted to us online via our designated form www.bhliveactive.org.uk/course-cancellation-form. No other forms of notice will be accepted. Notice periods defined in section 2.7.

2.8 Notice to end your Sports Membership. We calculate your Membership in whole calendar months. Consequently:

2.8.1 If your collection date is the 1^st day of the month:

if you give notice to cancel your Membership up to and including the fourth day of the month, your notice will be deemed to take effect from the first day of that month. For example, if you give notice to end your Membership by midnight on the 4^th November, we will treat your notice as being effective from 1^st November and your membership will then end on 30^th November;

if you give notice to cancel your Membership, after the fourth day of the month, your notice will be deemed to take effect from the first day of the next calendar month. For example, if you give notice to end your Membership on 5^th November, we will treat your notice as being effective from 1^st December and your membership will then end on 31^st December.

 2.8.2 If your collection date is the 15^th day of the month:

if you give notice to cancel your Membership up to and including the nineteenth day of the month, your notice will be deemed to take effect from the fifteenth day of that month. For example, if you give notice to end your Membership by midnight on the 19^th November, we will treat your notice as being effective from the 15^th November and your membership will then end on the 14^th December;

if you give notice to cancel your Membership after the nineteenth day of the month, your notice will be deemed to take effect from the fifteenth day of the next calendar month. For example, if you give notice to end your Membership on 20^th November, we will treat your notice as being effective from 15^th December and your membership will then end on 14^th January.

2.9. Squad Fee’s Memberships are offered on an hours per week scale. Increase in attendance beyond your specified plan will result in fee increases.

2.10. Non-Payment of a Direct Debit will automatically render your Sports Membership into suspension and access to your activity will not be permitted.

 3. Cash Plans

 3.1. Swimming Academy Cash Plans must be paid upfront at point of booking. No refunds shall be given on Cash Plans (however where clause 2.3 applies, this does not affect your statutory rights and you have a 14-day cooling-off period from the date of purchase).

3.2 Littledown Juniors Cash Plans must be paid upfront at point of booking. No refunds shall be given

on Cash Plans (however where clause 2.3 applies, this does not affect your statutory rights and you can change your mind prior to the commencement of the service).

3.3 Pre-School Gymnastics Cash Plans must be paid upfront at point of booking. No refunds shall be given on Cash Plans (however where clause 2.3 applies, this does not affect your statutory rights and you can change your mind prior to the commencement of the service).

4. Increases in Membership Fees.We reserve the right to increase Membership fees at any time, however we will give you notice to let you know and you will have the right to end your Membership under clause 2.7.

5.  Restrictions for Memberships

5.1. The right to free swimming sessions will only be applicable whilst you hold a fully paid Swimming Academy Membership and your right to access swimming sessions for free will cease following your final swimming lesson. Free swimming sessions are included at Littledown Centre during term time only. Free swimming sessions are subject to availability and only included at your home site where your lessons take place.

5.2. The right to free and/or discounted court hire and specific PAYG sessions will only be applicable whilst you hold a fully paid Tennis Membership and your right to access member benefits will cease following your final lesson. Member benefits are included at Portsmouth Tennis Centre only and are subject to availability.

5.3. The right to discounted Adult PAYG sessions will only be applicable whilst you hold a fully paid Gymnastics Membership and your right to access member benefits will cease following your final lesson. Member benefits are included at Portsmouth Gymnastics Centre only and are subject to availability.

6. In the event of a pool closure (planned or unforeseen), lessons will be relocated wherever possible or cancelled if necessary. No refunds or credits will be given.

7. Parents/guardians with children under 8 years of age must remain on site and the duration of their visit/ activity. Parents/guardians are not permitted in activity areas (pools, gyms, courts) except where specific sessions require the attendance of an accompanying adult. Poolside spectating is not available at Corfe Mullen.

8. Due to sickness, staff training or teachers leaving the employment of BH Live, it may be necessary for your teacher/coach to change. There will be no compensation for such changes.

9. Approximately five minutes per lesson will be allocated to the administration of registration and record of achievement for pupils.

10. PROVIDING THE SERVICES

10.1 We are not responsible for delays outside our control. If our performance of the services is affected by an event outside our control, then we will contact you as soon as possible to let you know. We may, at any time, need to withdraw all or part of the facilities for any period or periods of time, and with or without notice in connection with any unexpected major events, cleaning, repairs, alterations or maintenance work, or for any other reason beyond our control. We will take steps to minimise the effect of the delay such as suggesting equivalent services at an alternative centre under your Membership.

10.2   Reasons we may suspend the services. We may have to suspend the provision of services:

10.2.1 to deal with technical problems or make minor technical changes.

10.2.2 to update the services to reflect changes in relevant laws and regulatory requirements.

10.2.3 as necessary in connection with any major events, cleaning repairs, alterations, or maintenance work, or for any reason beyond our control. No financial compensation to members will be given in these circumstances.

10.2.4 we may cancel up to 4 weeks of a Littledown Juniors defined season due to adverse weather or other extenuating circumstances. In this instance, no compensation will be provided.

 12. Parking Facilities. Parking restrictions apply and vary from centre to centre. 

Direct Debit Guarantee

• This Guarantee is offered by all banks and building societies that accept instructions to pay Direct Debits.
• If there are any changes to the amount, date or frequency of your Direct Debit, BH Live Limited will notify you 10 working days in advance of your account being debited or as otherwise agreed. If you request BH Live Limited to collect a payment, confirmation of the amount and date will be given to you at the time of the request.
• If an error is made in the payment of your Direct Debit, by BH Live Limited or your bank or building society you are entitled to a full and immediate refund of the amount paid from your bank or building society.
• If you receive a refund, you are not entitled to, you must pay it back when BH Live Limited asks you to.
• You can cancel a Direct Debit at any time by simply contacting your bank or building society. Written confirmation may be required. Please also notify us.
