These Terms and Conditions constitute the contract between you and BH Live unless BH Live is acting as an 'Agent' on behalf of a local Council. In this instance, your membership contract is with the relevant Council, but BH Live, as the 'Agent', may enforce these Terms and Conditions on their behalf.

1. Our Sports Memberships;
2. Direct Debit Memberships
2.1 Sports Memberships will run for the Initial Term of 3 Direct Debit collections. The membership will continue beyond the Initial Term unless you give us notice to end your Membership. Payments following the Initial Term must be made by direct debit. If you wish to end your Sports Membership at the end of the Initial Term, we must receive your notice in line with notice periods outlined in 2.7.
2.2 Initial term does not apply to Littledown Juniors Memberships. Membership will run for the defined season period only.
2.3 On commencing your membership, any part monthly pro-rata payments must be made at the time of joining.
2.4 Exercising your right to change your mind. You have 14 days after the day we confirm your membership to change your mind. If you cancel after we have started the services, you must pay us for the services provided up until the time you tell us that you have changed your mind and stop using the services.
2.5 Your rights to freeze your Direct Debit membership. Sports memberships cannot be frozen except where you develop a medical condition that prevents you from using the services on an ongoing basis, in which case clause 2.6 below shall apply.
2.6 If you develop a medical condition that prevents you from using the services on an ongoing basis. An appropriate medical practitioner must provide written evidence, and we may, at our discretion, suspend your payments for two months. The participant will be removed from their sports course for the duration of the non-payment period. Course spaces are subject to availability on return.
2.7 Cancellation of your Sports Membership. Notices must be submitted to us online via our designated form www.bhliveactive.org.uk/course-cancellation-form. No other forms of notice will be accepted. Notice periods defined in section 2.8.
2.8 Notice to end your Sports Membership. We calculate your Membership in whole calendar months. Consequently:
2.8.1 If your collection date is the 1st day of the month:
if you give notice to cancel your Membership up to and including the fifth day of the month, your notice will be deemed to take effect from the first day of that month. For example, if you give notice to end your Membership by midnight on the 5th November, we will treat your notice as being effective from 1st November and your membership will then end on 30th November;
if you give notice to cancel your Membership, after the fifth day of the month, your notice will be deemed to take effect from the first day of the next calendar month. For example, if you give notice to end your Membership on 6th November, we will treat your notice as being effective from 1st December and your membership will then end on 31st December.
2.8.2 If your collection date is the 15th day of the month:
if you give notice to cancel your Membership up to and including the nineteenth day of the month, your notice will be deemed to take effect from the fifteenth day of that month. For example, if you give notice to end your Membership by midnight on the 19th November, we will treat your notice as being effective from the 15th November and your membership will then end on the 14th December;
if you give notice to cancel your Membership after the nineteenth day of the month, your notice will be deemed to take effect from the fifteenth day of the next calendar month. For example, if you give notice to end your Membership on 20th November, we will treat your notice as being effective from 15th December and your membership will then end on 14th January.
2.9. Squad Fee’s Memberships are offered on an hours per week scale. Increases in attendance beyond your specified plan will result in fee increases.
2.10. Non-Payment of a Direct Debit will automatically render your Sports Membership into suspension and access to your activity will not be permitted.
3. Cash Plans
3.1. Swimming Academy Cash Plans must be paid upfront at point of booking. No refunds shall be given on Cash Plans (however, where clause 2.3 applies, this does not affect your statutory rights, and you have a 14-day cooling-off period from the date of purchase).
3.2 Littledown Juniors Cash Plans must be paid upfront at point of booking. No refunds shall be given on Cash Plans (however where clause 2.3 applies, this does not affect your statutory rights, and you can change your mind prior to the commencement of the service).
3.3 Pre-School Gymnastics Cash Plans must be paid upfront at point of booking. No refunds shall be given on Cash Plans (however where clause 2.3 applies, this does not affect your statutory rights, and you can change your mind prior to the commencement of the service).
4. Increases in Membership Fees. We reserve the right to increase Membership fees at any time; however we will give you notice to let you know, and you will have the right to end your Membership under clause 2.7.
5. Restrictions for Memberships
5.1. The right to free swimming sessions will only be applicable whilst you hold a fully paid Swimming Academy Membership and your right to access swimming sessions for free will cease following your final lesson. Free swimming sessions are subject to availability and do not include premium pool sessions or inflatables.
5.2. The right to free and/or discounted court hire and specific PAYG sessions will only be applicable whilst you hold a fully paid Tennis Membership and your right to access member benefits will cease following your final lesson. Member benefits are included at Portsmouth Tennis Centre only and are subject to availability.
5.3. The right to discounted Adult Gymnastics PAYG sessions will only be applicable whilst you hold a fully paid Gymnastics Membership and your right to access member benefits will cease following your final lesson. Member benefits are included at Portsmouth Gymnastics Centre only and are subject to availability.
5.4. The right to free swimming and gym sessions will only be applicable whilst you hold a fully paid Diving Lessons or Diving Academy Membership and your right to access swimming and gym sessions for free will cease following your final lesson. Free swimming sessions are subject to availability and do not include premium pool sessions or inflatables.
6. Members of the Diving Academy (Club) and PGC Squad (Club) acknowledge that scheduled sessions may occasionally be cancelled or rescheduled due to coaches being required to attend competitions. As the same coaches also accompany divers when it is their turn to compete, this may at times affect training availability for other members. While we aim to minimise disruption, no refunds, credits, or compensation will be provided for sessions missed or cancelled as a result of coach attendance at competitions.
7. Parents/guardians with children under 8 years of age must remain on site and the duration of their visit/ activity. Parents/guardians are not permitted in activity areas (pools, gyms, courts) except where specific sessions require the attendance of an accompanying adult. Poolside spectating is not available at Corfe Mullen.
8. Due to sickness, staff training, or teachers leaving the employment of BH Live, it may be necessary for your teacher/coach to change. There will be no compensation for such changes.
9. Approximately five minutes per lesson will be allocated to the administration of registration and record of achievement for pupils.
10. Providing the services
10.1 We are not responsible for delays outside our control. If our performance of the services is affected by an event outside our control, then we will contact you as soon as possible to let you know. We may, at any time, need to withdraw all or part of the facilities for any period or periods of time, and with or without notice in connection with any unexpected major events, cleaning, repairs, alterations or maintenance work, or for any other reason beyond our control. We will take steps to minimise the effect of the delay, such as suggesting equivalent services at an alternative centre under your Membership.
10.2 Reasons we may suspend the services. We may have to suspend the provision of services:
10.2.1 to deal with technical problems or make minor technical changes.
10.2.2 to update the services to reflect changes in relevant laws and regulatory requirements.
10.2.3 as necessary in connection with any major events, cleaning repairs, alterations, or maintenance work, or for any reason beyond our control.
10.3 We reserve the right to cancel up to three (3) lessons per calendar year for any reason, without providing compensation to members. If a member experiences four (4) or more cancellations within the same calendar year, financial compensation may be considered at our discretion, depending on the circumstances. This policy is accounted for in the calculation of our membership fees.
10.4 We may cancel up to 4 weeks of a Littledown Juniors defined season due to adverse weather or other extenuating circumstances. In this instance, no compensation will be provided.
